1. Definitions

• "Bahtera Usaha" / "We" / "Us": Refers to the business school operating from No. 31, Jalan Merdeka, Taman Melaka Raya, 75000 Melaka, Malaysia.
• "Programme": Any of the three structured business education programmes offered by Bahtera Usaha, as described on our website and in our programme scope documents.
• "Participant" / "You": An individual who has enrolled in a programme or who has submitted an enquiry with the intention of enrolling.
• "Scope Document": The written summary of programme content, duration, inclusions and fee provided to a participant before enrolment is confirmed.
• "Cohort": The group of participants enrolled in the same programme intake.

2. Acceptance of Terms

By submitting an enquiry through our website or by enrolling in a programme, you confirm that:

• You are at least 18 years of age.
• You have read and understood the programme scope document relevant to your enrolment.
• You accept these Terms and Conditions and our Privacy Policy.

3. Programme Description and Availability

Bahtera Usaha currently offers three programmes: Starting a Business Properly (RM 225), Trade, Export and Supply Chain Practice (RM 445), and the Business Leadership Programme with Advisory Panel (RM 810). Each programme is described fully on our website and in the scope document provided before enrolment.

We reserve the right to cancel or postpone a programme intake if the minimum enrolment threshold for that intake is not reached, or for reasons outside our control. In such cases, participants will be offered a full refund or a transfer to the next available intake.

4. Enrolment and Payment

Enrolment is confirmed when we have received your completed enquiry, assessed programme fit, and received payment of the programme fee. Payment is accepted by bank transfer to the account details provided in our enrolment confirmation email. No enrolment is reserved without payment.

Fees are quoted and payable in Malaysian Ringgit (MYR). Published fees are all-inclusive — there are no additional materials costs or session surcharges beyond the fee stated in the scope document.

5. Cancellation and Refunds

Participants who wish to withdraw from a programme should notify us in writing to [email protected] as early as possible.

• Withdrawal more than 14 days before intake start: Full refund of the programme fee.
• Withdrawal within 14 days of intake start: 50% refund of the programme fee.
• Withdrawal after the intake has begun: No refund, but a transfer to the next available cohort may be arranged at the faculty's discretion.

If a participant is unable to continue mid-programme due to a documented serious illness or significant personal emergency, we will consider a transfer to a future cohort on a case-by-case basis.

6. Participant Responsibilities

Participants are expected to:

• Attend sessions with reasonable regularity. Consistent non-attendance may affect the faculty's ability to provide individual reviews and written feedback.
• Treat other cohort members' business information as confidential in accordance with the cohort confidentiality framework agreed at the start of each intake.
• Engage with programme materials honestly and in good faith.
• Notify the faculty promptly if their circumstances change in a way that affects their participation.

7. Intellectual Property

All programme materials — including session content, templates, document sets and written reports produced by Bahtera Usaha faculty — remain the intellectual property of Bahtera Usaha. Participants are granted a non-exclusive licence to use these materials for their own business purposes.

Participants may not reproduce, distribute or commercially exploit programme materials without written permission from Bahtera Usaha.

Materials produced by participants during a programme — including business plans, case notes and personal working documents — remain the property of the participant.

8. Disclaimers

Bahtera Usaha programmes are educational in nature. They do not constitute legal, financial, accounting or professional advice. Participants should seek qualified professional advice for decisions that require it.

We do not represent that attendance at any programme will result in a particular business outcome. Results depend on the participant's individual circumstances, decisions and actions taken outside the programme.

9. Limitation of Liability

To the extent permitted by Malaysian law, Bahtera Usaha's total liability to any participant for claims arising from or relating to a programme shall not exceed the programme fee paid by that participant.

We are not liable for indirect or consequential losses, including loss of business, revenue or profit, even where we were made aware of the possibility of such loss.

10. Dispute Resolution

If a dispute arises in connection with these Terms, both parties agree to first attempt to resolve it through direct discussion. Disputes that cannot be resolved informally will be subject to the jurisdiction of the courts of Malaysia, and these Terms are governed by Malaysian law.

11. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your enrolment applies to your programme. Material changes will be communicated to enrolled participants by email before taking effect.
